€40K AWARD TO HILLWALKER INJURED ON THE WICKLOW WAY TO BE APPEALED

Last week Teresa Wall from Swords in Co. Dublin sued the National Parks & Wildlife Service after she fell on a boardwalk section of the Wicklow Way. She was awarded €40,000 in damaged but the judgement is to be appealed.

The Judge in the case had found that Wicklow Mountains National Park's maintenance regime was poor and made the award to Teresa Wall under Section 4 of the Occupiers Liability Act which places a higher duty of care on occupiers where structures are provided for use primarily by recreational users. In this case, Ms Wall injured her knee when she fell on a boardwalk of partially rotten sleepers in August 2013.
The decision is to be appealed and and papers will be lodged within a matter of days.
